The issue of September-October 2018 of The Trademark Reporter®, the INTA publication, has just been released.
This issue includes two articles and three book reviews. The articles are the following:
Quentin J. Ullrich, “Corpora in the Courts: Using Textual Data to Gauge Genericness and Trademark Validity”, A groundbreaking article proposing the use of corpora—large databases of text that allow for the statistical approximation of how a given word is used—in lieu of genericness surveys to measure consumers’ understanding of a term as generic or trademarked.
Faux Pas / Jessica Elliott Cardon, “Commentary: Co-Branding with Influencers Is in Fashion and No Longer a Trademark”. An insightful commentary exploring the risks and rewards of co-branding by an untested fashion and celebrity social media influencer and an established fashion house to cross-promote a product or collection of products in the hope of attracting the influencer's digital audience.
Both articles are freely available in the Internet
Fabrizio Miazzetto, partner at BAYLOS, is member of the editorial board of the Trademark Reporter® and is currently a Senior Editor and a Co- chair of the Books and Commentaries Review Subcommittee of that board.
