The judgment was handed down by the Supreme People’s Court of China last month and it means the culmination of a long-running legal battle over the registered the trademark "Manolo & Blahnik" filed by private individual, which prevented the British company that bears the name of its Spanish founder, from using his trademark in China. At last, and not without having to take endless actions against this Chinese businessman, Manolo Blahnik has managed to prevail over this earlier trademark by winning the invalidity proceeding. In short, the UK based company can finally market its trademark in the Asian country and sets a very important precedent for other brands in the fashion industry to assert their rights against these trademark trolls so widespread in China.
