None Of Your Business (NOYB), the non-profit organization led by Max Schrems, has issued complaints against Fitbit, the smartwatch that has been a part of Google since 2021, in Italy, Austria and the Netherlands.
The complaint is based on the lack of legitimacy to carry out international data transfers; failure to obtain consent in an adequate and valid manner; failure to comply with the provisions of Article 12 regarding the duty of transparency; and failure to comply right of access provision, included in Article 15 of the GDPR.
According to NOYB, the fine it expects to be imposed could exceed $1 billion.
