UK courts agree with the small brand "House of Zana" and reject ZARA’s opposition

ZARA has an extensive reputation not only for its well stablished business but also for the strong protection of its rights. The fact that the UK application “House of Zana” may entail a risk of confusion was probably assessed by its legal team who decided to act against it. However, the UK courts have ruled that , although the outstanding reputation of a trademark, it did not consider this trademark such a threat and overrule likelihood of confusion relaying on the fact that, indeed, the application has two more words "House of" and in the letter "n" of "Zana", as well as in the visual elements that would ensure that the average consumer would not associate them with ZARA.
